E-MAIL AND VOICE MAIL POLICY

__________ ("Employer") maintains a voice-mail system and an electronic mail (E-mail) system to assist in the conduct of its business. These systems, including the equipment and the data stored in the system, are and remain at all times the property of the Employer. As such, all messages created, sent, received or stored in the system are and remain the property of the Employer.

The employee’s use of the E-mail and/or voice mail systems should be limited to messages necessary to conduct Employer’s business. The Employer’s voice mail and e-mail systems should not be used for employee’s personal activities. All equipment shall be cared for to avoid breakage or damage. All breakage or damage to equipment or loss of same must be reported immediately.

The Employer reserves the right to review any message sent or received on its system. Because the Employer may need to access your system, all passwords must be made known to the Employer. Even when a message is deleted, it is still possible to recreate the message. Therefore, the Employer does not ensure the confidentiality or privacy of any e-mail or voice mail message.

No employee is permitted to send an E-mail or voice mail message on Employer’s system which contains a message that may be considered offensive or disruptive to any employee. Offensive content includes, but is not limited to, sexual suggestive comments, jokes or images, racial slurs, gender-specific comments or any comments that would offend someone on the basis of his or her age, sexual orientation, religion, national origin, or disability, or otherwise create an offensive working environment.

Employees learning of any misuse of the voice-mail or E-mail system or violations of this policy shall notify __________.

I acknowledge that I have read and understand the E-mail and voice mail policy set forth above and that violation of this policy could result in discipline up to and including discharge.
